DMCA information and policies

Uncharted Blue Media protects the rights of intellectual property owners, and our site users are expected to also respect those rights. In accordance with the Digital Millenium Copyright Act, we will respond expeditiously to claims of copyright infringement. After receiving a Notice of alleged infringement, Uncharted Blue Media will investigate and, at the company's discretion, may:

(1) remove the allegedly infringing material from our site, and/or
(2) notify the user responsible for the alleged infringement, and/or
(3) remove the ability for that user to post content on our site in the future.

Filing a Notice of alleged infringement

Copyright holders or their authorized representatives may report Notices of alleged infringements to DMCA@unchartedbluemedia.com.

Your Notice MUST include the following information:

  1. A full description of the copyrighted work or works you believe is being infringed on, including a URL if applicable.
  2. An exact URL or URLs showing the alleged infringements on our site. If the alleged infringement is within a user comment, include either a link to that specific comment or the user name and exact text of the comment. Our agents can only review claims that include enough detail to expeditiously locate the alleged infringement.
  3. A means of contacting you. Include your name, relationship to the intellectual property allegedly infringed upon, mailing address, telephone number, and email address.
  4. A statement under penalty of perjury asserting your own good faith belief that no copyright owner or representative authorized the described use of the described copyrighted material.
  5. A statement under penalty of perjury attesting to the accuracy of all parts of the Notice:
    "I hereby state, under penalty of perjury, that the information provided in this Notice is accurate and that I am the owner or am authorized to act on behalf of the owner of the copyright allegedly infringed."
  6. Your full name and electronic signature.

Submit your Notice to DMCA@unchartedbluemedia.com with the subject line "Notice".

Filing a Counter Notice challenging a Notice of alleged infringement

The DMCA allows the posters of allegedly infringing material to challenge such Notices, which is accomplished by filing a "Counter Notice" that we will then forward to the filer of the original Notice.

Your Counter Notice MUST contain:

  1. A full description of the material in dispute, including an exact URL or other means of identifying it.
  2. Your contact information. Include your name, mailing address, telephone number, and email address.
  3. A statement under penalty of perjury that you have a good faith belief that the claim of infringment is in error.
  4. A statement consenting to (1) the jurisdiction of the Federal District Court for the judicial district in which your provided address is located and (2) consenting to service of process from the person who filed the original Notice or their agent.
  5. Your full name and electronic signature.

Submit your Counter Notice to DMCA@unchartedbluemedia.com with the subject line "Counter Notice".

We will forward your Counter Notice to the filer of the original Notice for their review. The filer of the original Notice will have 10 days to notify us that they have filed legal action relating to the alleged infringement. If no such notification is received, our company may, at our discretion, restore access to the material.

Other policies

Uncharted Blue Media may, at our discretion, block users who repeatedly post content that appears to infringe on intellectual property owned by others. We may also take legal action against persons or entities who submit a Notice or Counter Notice that we reasonably believe to contain false information or to have been submitted in bad faith.
